The article examines the problem of defining cyberspace as a setting for committing a criminal offense and reveals the inherent features of this category. A critical analysis of traditional forensic approaches to the structure of the crime setting, based on a material and physical understanding of the environment, is carried out. The impossibility of applying these approaches to crimes committed in a digital environment is justified, and specific features of cyberspace as a forensically significant reality are determined. A forensic classification of criminal offenses that can be committed in cyberspace is presented, taking into account the motivational factor and object-functional orientation. An adapted forensic classification of the cybercrime setting by the stage of implementation of the act, the dynamics of changes in its elements, the impact on criminal behavior, and the degree of predictability is proposed. The need to form new methodological approaches to the study of the digital environment to increase the efficiency of pre-trial investigation in the context of digitalization is emphasized.
