Problems of Teaching Criminal Law Disciplines during the Implementation of European Integration Processes

Abstract

The article examines the specifics of teaching criminal law disciplines during the implementation of European integration processes in modern conditions. These conditions are currently linked to the Russian-Ukrainian war, as well as the ongoing implementation of European and Euro-Atlantic integration reforms as a countermeasure to this war and its consequences. The author analyzes available sources regarding the teaching of European Criminal Law and Procedure, as well as the creation of related (complex) academic disciplines in the field of criminal law. Attention is drawn to the interconnection of all criminal law disciplines, implying a unified process and a shift in teaching approaches during such reforms (using criminal law as an example). Based on the implemented project "Modernization of Legal Education in Support of European and Euro-Atlantic Integration of Ukraine [EU4UA]," the Recommendations for improving the syllabi of core legal disciplines to promote Ukraine's European and Euro-Atlantic integration were studied. Their analysis revealed several issues: the establishment of minimum European and Euro-Atlantic integration standards for the disciplines "Criminal Law: General Part" and "Criminal Law: Special Part"; the provision of minimum standards only within the framework of established primary sources, leaving additional sources to the discretion of syllabus (academic/working program) developers; and the gradual alignment of syllabi with EU terminology.
