Disciplinary liability of judges: international experience and practice
Abstract
This article examines issues related to the disciplinary liability of judges, its legal nature, and international standards. It analyzes the practice of the European Court of Human Rights (ECHR) in cases concerning disciplinary control over judges and compares the national systems of various countries, including France, Italy, Germany, Austria, Poland, and the United States, among others. A comparative analysis is conducted of the composition of disciplinary bodies, disciplinary proceedings, and mechanisms for the protection of judges. Attention is paid to the application of ECHR decisions in disciplinary proceedings, and directions for the development of the institution of disciplinary liability in Ukraine are identified. It is concluded that disciplinary liability serves not only as a punitive mechanism but also as an effective tool for maintaining professional standards among the judiciary, strengthening the independence of the judiciary, and building public trust in the judicial system.
